These are the rules by which the Win a Trip for Two to Indochina Contest (“the contest” or simply “contest”) shall be governed. Note that if you have registered for the contest you agree to be bound by these terms and conditions.

Contest Period

1. The Contest will begin on Monday, December 8, 2008 at 12:00:01 a.m. PT and ends on Tuesday, January 15, 2009 at 11:59:59 p.m. PT (“Contest Period”).

Eligibility

2. The contest is open globally to residents who are 18 years of age or older at the time of entry (“Entrant”). Not valid in Quebec, Canada.
3. Employees of GeckoGo Corp and Buffalo Tours (“Sponsors”) and each of their parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents, and members of such employees’ immediate families and individuals living in the same household with such employees, are not eligible to win.
4. Individuals residing in states and/or countries in which sweepstakes are unlawful are not eligible to participate in the contest.
5. The contest is open to all registered members of GeckoGo.
6. The Sponsors’ decision on winner eligibility is final and binding.

To Enter

7. Each Entrant must log onto the website www.geckogo.com/buffalo-tours and follow the instructions to: (1) register for an account on GeckoGo and (2) enter the contest (“Contest Entry” or “Contest Entries”).
8. Contest Entries must be submitted electronically and must be manually key stroked by each Entrant. Automatic entries will not be accepted.
9. Contestants must ensure that their registration is complete and accurate. Incomplete or invalid registrations shall be disqualified.
10. A double or multiple registration by any member will not increase the chance of winning.
11. Entrants may obtain Bonus Entries by:
1. Logging in to your profile (max. 1x per day)
2. Writing a tip
3. Writing a review
4. Contributing to a country wiki
5. Posting a blog update
6. Inviting a friend
7. When your friend accepts
12. The Sponsors reserve the right to use our discretion on what qualifies for bonus entries. Any material that contains obscenities, objectionable matter, material that is copyrighted, trademarked or patented by anyone other than the Entrant, or that defames or invades the publicity or privacy rights of any person living or deceased or otherwise infringe upon any third party’s personal or proprietary rights will be disqualified.
13. There is no limit to the number of qualified entries allowed per person.
14. No purchase necessary. Purchasing through GeckoGo websites and partner websites does not increase chances of winning.
15. All contest entries must be submitted in English via the contest registration page. Other languages will not be accepted by GeckoGo.

Determination of Contest Winner

16. Winners will be selected from among all eligible entries in a random drawing under the supervision of a Notary Public on Jan 20 2009 at GeckoGo, 2149 Junction Ave. Unit 2, Mountain View, CA 94043. Odds of winning depend on the number of entries received. A potential winner from Canada (outside Quebec) will be required to complete a skills test before claiming prize.
17. To be eligible to win the grand prize, contestants must have registered accounts on GeckoGo website during the contest period and continue to hold a registered GeckoGo account up until the final day of the contest period. Creating an account is free and does not incur any obligation.

Contest Prize

18. Grand Prize: One Grand Prize will be awarded, consisting of a standard tour package for the winner only in South East Asia with Buffalo Tours valued between $2000-3000 USD. All standard Buffalo Tour conditions and restrictions apply, including those posted at BuffaloTours.com Prize will be awarded from a Buffalo Tours location (and not from GeckoGo’s location in California).
19. The Sponsors reserve the right to change the prize without any prior notification.
20. The contest winner shall be responsible for all costs related to, but not included in, the prize, including but not limited to legal cost, taxes, insurance, travel, meals, personal expenses, or fees. Winner is solely responsible for providing all necessary travel documentation, including passport and visas. Airfare to Indochina is not included.
21. The potential winner will be notified by email within five (5) days of the determination date of the winner.
22. The winner will be required to complete and return an Affidavit of Eligibility and Liability and Publicity Release (“Affidavit and Release”) which must be completed, signed and returned within fourteen (15) days from the date of issuance, or all rights will be forfeited and an alternate winner will be chosen.
23. The name and address of the winner will posted on the website www.geckogo.com within fifteen (15) days of the determination date of the winner.
24. Prizes not claimed within fifteen (15) days of notification from GeckoGo shall be forfeited. Contest winners are solely responsible for collection of their prize and GeckoGo and its agents, sponsors, and representatives shall have no liability to the contest winners in any respect whatsoever.
25. Prizes are non-transferable and there is no cash alternative.
26. The Sponsors reserve the right to request written proof of the age and identity of any contest winner before the prize is collected by the contest winner.
27. The Sponsors make no warranties or representations whatsoever with respect to the prize and shall not be responsible nor liable for any problems and/or damage thereto or arising therefrom.
28. Prizes involving reservations or booking must be used within 12 months of the end of the contest or will be forfeited.
29. In the event that a contest winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of GeckoGo.
30. All prizes are accepted entirely at the risk of the contest winner, and GeckoGo excludes all warranties in connection with any prize to the extent permitted by law. Contest winners shall comply with the terms and conditions of each prize.
31. Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Contest or any portion thereof, or to disqualify any individual implicated in any of the following actions, if for any reason:
1. infection by computer virus, bugs, tampering, unauthorized intervention, actions by Entrants, fraud, technical failures, or any other causes which, in Sponsors’ sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest,
2. the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of Contest Entries in accordance with these Official Rules, or
3. the Contest is otherwise not capable of running as planned.

General Terms & Conditions

32. The promoter is not responsible for lost entries. Entries received by post will not be processed.
33. All contestants shall be required to adhere to the Contest Terms and Conditions including any changes made thereto. GeckoGo reserves the right to withhold the prize(s) from an apparent winner in the event any of the Contest Terms and Conditions are not adhered to.
34. GeckoGo reserves the right to change, amend, delete or add to these Contest Terms and Conditions without prior notice at any time and the contestants shall be bound to such changes.
35. GeckoGo reserves the right to cancel, terminate, or suspend the contest with or without prior notice. Termination or suspension by GeckoGo of the contest shall not entitle the contestants to any claim or compensation against GeckoGo for any and all loss or damage suffered or incurred by the Contestants as a direct or indirect result of the act of cancellation, termination, or suspension.
36. The sweepstakes is VOID IN QUEBEC, CANADA, AND VOID WHERE PROHIBITED.

Liability

37. By entering, Entrants agree to release and hold harmless Sponsors and each of their parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or Contest Entry into the Contest or acceptance, delivery or use of the Grand Prize. The Released Parties are not responsible or liable for any incorrect or inaccurate Contest Entry information, and assume no responsibility for (i) typographical or other errors in the printing of the promotion materials or the offering or announcement of the prizes, including any error that results in an erroneous notification of prize, (ii) any error, omission, interruption, defect or delay in operation or transmission at any website, (iii) failure of any Contest Entry to be received by Sponsors due to technical problems, telephone service problems, printing errors, human error or traffic congestion on the Internet or at any website, (iv) communications line, hardware and/or software failures, (v) damage to any computer (software or hardware) resulting from participation in the Contest, (vi) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or Contest Entry information, or (vii) entries which are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof). In no event will more than the stated number of prizes be awarded. By entering, Entrants agree to comply with these Official Rules.
38. GeckoGo will not be responsible for:
1. Any problem, damage, or loss of whatsoever nature to any contestant, or their representatives resulting from participation in the contest.
2. Any error (including error in notification of contest winners), omission, interruption, deletion, defect, delay in operation or transmission, data line failure, theft, destruction, alteration of, or unauthorized access to entries or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs, or other causes outside its control.
39. If, for any reason, the giveaway is not capable of being completed as planned, including, but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the giveaway.

Disqualification

40. Any Entrant who attempts to tamper with this Contest in any way shall be disqualified. In the event of dispute as to who submitted an online Contest Entry, the Contest Entry will be deemed submitted by the Authorized Account Holder (as defined below) of the email address submitted at the time of Contest Entry. For the purposes of these Official Rules, “Authorized Account Holder” shall mean the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. Additional restrictions may apply.
41. GeckoGo reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or operation of the contest, to be acting in breach or potential breach of these Contest Terms and Conditions. No correspondence shall be entertained.

Arbitration/Choice of Law:

42. Except where prohibited, Entrants agree that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by Entrant with regard to this Contest, but in no event attorneys' fees, punitive, incidental, consequential or other damages. All issues and question concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants and Sponsors in connection with the Contest shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than California. The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
