OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.
ELIGIBILITY: The “GeckoGo Search for the Ultimate Intrepid
Traveler Contest” (“Contest”) is open globally to residents who are 18 years of age or older at the time of entry
(“Entrant”). Employees of GeckoGo Corp and Intrepid U.S., Inc.
(“Sponsors”) and each of their parent, subsidiary companies,
affiliates, divisions, franchisees, representatives,
consultants, sub-contractors, suppliers, distributors, legal
counsel, advertising, public relations, promotional, fulfillment
and marketing agencies, and their officers, directors,
employees, shareholders and agents, and members of such
employees’ immediate families and individuals living in the same
household with such employees, are not eligible to win. The
Contest will begin on Wednesday, October 1, 2008 at 12:00:00
a.m. PT and ends on Friday, October 31, 2008 at 11:59:59 p.m. PT
(“Contest Period”).
TO ENTER: Each Entrant must log onto the website www.geckogo.com/contest and follow the instructions to complete the following: (1) Sign up for a GeckoGo Account (2) Create a travel profile-including countries visited, travel interest and a profile picture (“Contest Entry” or “Contest Entries”).
Contest Entries must be submitted electronically and must be manually key stroked by each Entrant. Automatic entries will not be accepted. All Contest Entries, must be received no later than 11:59:59 p.m. PT. on October 31, 2008. By entering the Contest, all Entrants acknowledge receipt of and compliance with these Official Rules. Odds of winning depend on the score and content of all eligible Contest Entries received.
JUDGING CRITERIA.All Contest Entries, will be judged
collectively according to the same judging criteria by a panel
of GeckoGo Judges (“Judges”) and 10 semi-finalists will be
selected based on a composite score using the following criteria
(“Judging Criteria”):
1. Travel Experience
2. Passion for Travel
3. Writing Style
4. Personality - helpfulness, friendliness
Beginning November 1, 2008, the Judges will review all Contest Entries based on the Judging Criteria. The panel of Judges will choose the top ten (10) Contest Entries based on a composite score, using the Judging Criteria, to advance to the semi-final round. The final round will begin on Monday, November 3, 2008 at 12:00:00a.m. PT and will end on Sunday, November 9, 2008 (“Final Round) at 11:59:59p.m. PT. The Final Round will consist of voting by registered members of GeckoGo.com (“Members”). Members will review and judge the Contest Entries based on the Judging Criteria. Members may vote once per calendar day. Winning a prize is determined solely based on the highest scores achieved under the Judging Criteria. Winning is contingent upon fulfilling all requirements of these Official Rules and Sponsors’ decisions as to the administration of the Contest and prize awards are final.
TIES: In the event of a tie score between two or more Entrants, then the Judges will select the Grand Prize winner based on the Judging Criteria.
INFRINGING RIGHTS OF OTHERS: Entries must be 100% original creations not containing any copyrighted material including by way of example and not by limitation. Any Contest Entry that contains material suspected of being intellectual property of some other person or entity and cannot be proved to be original will be disqualified. Any Contest Entry that contains obscenities, objectionable matter, material that is copyrighted, trademarked or patented by anyone other than the Entrant, or that defames or invades the publicity or privacy rights of any person living or deceased or otherwise infringe upon any third party’s personal or proprietary rights will be disqualified.
OWNERSHIP/RIGHTS: Except as specifically provided for herein,
Entrant agrees by submitting a Contest Entry that the Contest
Entry is free of any copyright trademark or patent rights or
other intellectual property belonging to anyone else. Entrant
further agrees that Sponsors may use any or all of the Contest
Entry in any manner deemed necessary for the purpose of this
Contest without any payment of fees or royalties. Entrant agrees
that Sponsors may assign all right, title and interest in the
Contest Entry granted by Entrant hereunder to any party at
Sponsors’ sole discretion.
PUBLICITY RELEASE: Except where prohibited, entry in the Contest
constitutes each Entrant’s consent to use, publish, reproduce
and for all purposes, including publicity, promotion and
advertising, in any media (including without limitation, the
Internet, television or offline promotions), each winner’s name,
city, photograph, likeness, voice, image, and commercial each in
perpetuity without further compensation, credit or right of
review or approval.
PRIZES. There will be One (1) Grand Prize and Ten (10) Runner Up
Prizes.
Grand Prize: a “Surprise Trip of a Lifetime” for one to an
unusual destination (“Grand Prize”). The Grand Prize includes
accommodations and a stipend for meals during the duration of
the trip, transportation to and from destinations, local payment
fees and activity fees associated with the trip. The minimum
length of the Grand Prize is ten (10) days and the maximum
length is four (4) weeks. Grand Prize winner must keep a travel
journal or make 2 blog posts a week during the length of the
Grand Prize and provide a recap post of the Grand Prize trip on
the GeckoGo trip blog no later than one week after returning
from the Grand Prize. Entrants and Grand Prize winner understand
and expressly agree the Grand Prize will be awarded as a
surprise trip and further understand and agree that the
location, timing and duration of the Grand Prize is at Sponsors’
sole discretion. Departure city will be determined according to
the closest major airport to Grand Prize winner’s city and state
of residence and the terms and conditions imposed by the
applicable airlines apply. The Approximate Retail Value (“ARV”)
of the Grand Prize is $6,000.00 USD.
All expenses not expressly stated in the Grand Prize, including
by way of example and not by limitation, certain train, bus or
other ground transportation, upgrades, hotel incidentals, in
room charges (e.g. mini-bar, room service, telephone, Internet),
security fees, passport fees, travel visas, meals, gratuities,
phone calls, excursions, or insurance are the sole
responsibility of the Grand Prize winner. Travel restrictions,
blackout dates, conditions and limitations may apply. Sponsors
will not replace any lost or stolen tickets, travel vouchers or
certificates. The Grand Prize must be redeemed between December
2008 and December 2009 or the Grand Prize will be forfeited.
Grand Prize winner is responsible for all applicable taxes
incurred by winning the Grand Prize. Sponsors will provide the
Grand Prize winner with an IRS Form 1099 for the value of the
Grand Prize. Grand Prize winner is responsible for any
applicable fees and all insurance, federal, state and local
taxes, if any, and incidentals and any other unspecified
expenses associated with acceptance or use of the Grand Prize.
The Grand Prize is provided “as is” and without any warranty of
any kind. The Grand Prize is non-transferable. No cash
redemption or prize substitution allowed by winner. Sponsors
reserve the right to substitute a prize of equal or greater
value if the Grand Prize is unavailable and/or undeliverable for
any reason in the sole and complete discretion of Sponsors.
Runner Up Prize: Ten (10) Runner Up Prizes each consist of a $300 travel voucher to be redeemed towards a trip booked and/or reserved through Intrepid Travel (“Runner Up Prizes”). The Runner Up Prizes will be awarded to the top ten (10) Contest Entries based on a composite score, using the Judging Criteria, after the Final Round. The ARV of all Runner Up Prizes is $3,000.00.
All prizes will be awarded. No substitution or transfer of prizes is permitted. All taxes are the sole responsibility of the prize winners.
WINNER NOTIFICATION AND PRIZE DELIVERY: Grand Prize winner will
be notified by telephone, email and Federal Express on or about
Wednesday, November 9, 2008 and will be required to complete and
return an Affidavit of Eligibility and Liability and Publicity
Release (“Affidavit and Release”) which must be completed,
signed and returned within fourteen (14) days from the date of
issuance, or the Grand Prize will be forfeited and awarded to an
alternate winner. Grand Prize winner may waive his or her right
to receive the Grand Prize. If waived or forfeited, the Grand
Prize will be awarded to an alternate winner with the next
highest score.
Runner Up Prize winners will be notified by telephone and email
on or about Wednesday, November 9, 2009. Runner Up Prize winners
may waive his or her right to receive the Runner Up Prize. If
waived or forfeited, the Runner Up Prize will be awarded to an
alternate winner with the next highest score

ODDS: Odds of winning depend on the score and content of all
eligible Contest Entries received.
OTHER CONDITIONS: Sponsors reserve the right, in their sole
discretion, to cancel, terminate, modify or suspend the Contest
or any portion thereof, or to disqualify any individual
implicated in any of the following actions, if for any reason:
(a) infection by computer virus, bugs, tampering, unauthorized
intervention, actions by Entrants, fraud, technical failures, or
any other causes which, in Sponsors’ sole opinion, corrupt or
affect the administration, security, fairness, integrity or
proper conduct of the Contest, (b) the Contest or any website
associated therewith (or any portion thereof) becomes corrupted
or does not allow the proper processing of Contest Entries in
accordance with these Official Rules, or (c) the Contest is
otherwise not capable of running as planned. By entering,
Entrants agree to release and hold harmless Sponsors and each of
their parent, subsidiary companies, affiliates, divisions,
franchisees, representatives, consultants, sub-contractors,
suppliers, distributors, legal counsel, advertising, public
relations, promotional, fulfillment and marketing agencies, and
their officers, directors, employees, shareholders and agents,
and each of the foregoing entities’ employees, officers,
directors, shareholders and agents (collectively the “Released
Parties”), from and against any and all claims, actions and/or
liability for any injuries or death, loss or damage of any kind
arising from or in connection with participation in and/or
Contest Entry into the Contest or acceptance, delivery or use of
the Grand Prize and/or a Runner Up Prize. The Released Parties
are not responsible or liable for any incorrect or inaccurate
Contest Entry information, and assume no responsibility for (i)
typographical or other errors in the printing of the promotion
materials or the offering or announcement of the prizes, (ii)
any error, omission, interruption, defect or delay in operation
or transmission at any website, (iii) failure of any Contest
Entry to be received by Sponsors due to technical problems,
telephone service problems, printing errors, human error or
traffic congestion on the Internet or at any website, (iv)
communications line, hardware and/or software failures, (v)
damage to any computer (software or hardware) resulting from
participation in the Contest, (vi) theft or destruction of,
tampering with, unauthorized access to, or alteration of entries
and/or Contest Entry information, or (vii) entries which are
late, lost, stolen, damaged, illegible, and/or unintelligible
(or any combination thereof). By entering, Entrants agree to
comply with these Official Rules. Any Entrant who attempts to
tamper with this Contest in any way shall be disqualified. In
the event of dispute as to who submitted an online Contest
Entry, the Contest Entry will be deemed submitted by the
Authorized Account Holder (as defined below) of the email
address submitted at the time of Contest Entry. For the purposes
of these Official Rules, “Authorized Account Holder” shall mean
the natural person assigned to an email address by an Internet
access provider, on-line service provider or other organization
responsible for assigning email addresses for the domain
associated with the email address in question. Additional
restrictions may apply.
ARBITRATION/CHOICE OF LAW: Except where prohibited, Entrants
agree that any and all disputes, claims and causes of action
arising out of or connected with this Contest shall be resolved
exclusively by arbitration pursuant to the Rules of the American
Arbitration Association then effective, and any and all claims,
judgments and awards shall be limited to actual out-of-pocket
costs incurred by Entrant with regard to this Contest, but in no
event attorneys' fees, punitive, incidental, consequential or
other damages. All issues and question concerning the
construction, validity, interpretation and enforceability of
these Official Rules, or the rights and obligations of Entrants
and Sponsors in connection with the Contest shall be governed by
and construed in accordance with the laws of the State of California,
without giving effect to any choice of law or conflict
of law rules or provisions (whether of California or any other
jurisdiction) that would cause the application of the laws of
any jurisdiction other than California. The invalidity or
unenforceability of any provision of these Official Rules shall
not affect the invalidity or unenforceability of any other
provision so long as the general intent of these Official Rules
remains in effect. In the event that any such provision is
determined to be invalid or otherwise unenforceable, these
Official Rules shall be construed in accordance with their terms
as if the invalid or unenforceable provision was not contained
therein.
